Maricela Javier sued a Santa Monica hospital after her 54-year-old husband’s alleged improperly diagnosed COVID infection was treated with Remdesivir, and he died shortly thereafter.
“Victor Javier did not receive a diagnosis or treatment for his hiccups and instead was diagnosed with COVID-19,” the complaint states. “Even if Victor was properly diagnosed with COVID-19, he faced a very low risk of dying from COVID-19. But Victor’s risk of death dramatically changed for the worse when he was given high-risk and contraindicated drugs Remdesivir and Dexamethasone without the knowledge, or informed consent of Victor or Maricela.”
Dexamethasone is a high-risk corticosteroid that has not yet been approved by the FDA for COVID-19 treatment.
Providence Saint John’s Health is accused of failing to disclose the availability of a safe outpatient multi-drug early treatment for COVID-19, and instead treating with high-risk drugs Remdesivir and Dexamethasone
“It’s not a good drug,” said Dr. Bryan Tyson about Remdesivir. “It was supposed to stop RNA replication by inhibiting RNA Polymerases when that’s the same mechanism of action that hydroxychloroquine and Ivermectin use, but those two drugs are a lot safer on the kidneys and the liver than Remdesivir but the FDA approved the drug despite all of the side effects.”
The plaintiff seeks a damages award of more than the $25,000 jurisdictional limit.
The hospital is using Remdesivir despite the side effects for monetary reasons, according to Tyson, an El Centro physician who advocates for the use of Ivermectin and hydroxychloroquine to treat COVID-19.
“It’s $3,000 to $6,000 per treatment,” he said. “Remdesivir is one of these failed antivirals that the NIH has been trying to use for Ebola and so here’s a way to ‘make our money back. Let’s use it and see if it works for coronavirus.’ Well, it turns out it really didn’t work for coronavirus and just caused problems.”
The lawsuit further alleges that it is medically unethical to administer an unnecessary medical treatment and to treat a medical condition without informed consent.
“All of these vaccines, all of these mandates, all of these EUA drugs, all these experimental drugs and all these recently approved drugs are being mandated,” Tyson added. “Nobody is giving informed consent. They’re forcing people to do it against informed consent and that’s illegal.”
