Hours after the U.S. Supreme Court struck down his use of the International Emergency Economic Powers Act (IEEPA) to impose sweeping tariffs, President Donald Trump declared the ruling a victory — and immediately announced new tariffs under different statutory authority.
In remarks to reporters Friday, Trump insisted the Court merely restricted one specific use of IEEPA but reaffirmed broader presidential authority over trade. “I don’t think the court meant that, but it’s the way it is,” Trump said. “I can do anything I want with IEEPA, anything! I just can’t charge anybody for it.”
Trump then announced a 10% global tariff under Section 122 of the Trade Act of 1974, effective immediately.
Earlier Friday, the Court ruled 6–3 that IEEPA does not authorize the President to impose tariffs. Chief Justice John Roberts wrote that while IEEPA grants authority to regulate and restrict trade in emergencies, it does not explicitly grant tariff-imposing power.
The ruling invalidated tariffs enacted under IEEPA, but left intact those imposed under other statutes, including Section 232 and Section 301 authorities.
Trump seized on that distinction.
“The Supreme Court did not overrule tariffs,” Trump said. “They merely overruled a particular use of IEEPA tariffs.”
New Authority: Section 122
Trump announced he will invoke Section 122 of the Trade Act of 1974, which permits the President to impose tariffs of up to 15% for 150 days to address balance-of-payments deficits.
“Effective immediately,” Trump said, “all national security tariffs under Section 232 and existing Section 301 tariffs remain in place. Today, I will sign an order to impose a 10% global tariff under Section 122.”
He also announced new Section 301 investigations into what he called unfair trading practices by foreign countries and companies.
Trump predicted the revenue from these tariffs “could be far greater than the hundreds of billions we’ve already taken in.”
