Nina Jankowicz, the Biden administration’s failed “disinformation czar,” is lashing out after suffering yet another legal defeat in her quixotic war against Fox News. Once tapped to lead the infamous Disinformation Governance Board at the Department of Homeland Security, Jankowicz has now been left with nothing but fury, excuses, and a GoFundMe page.
The Court Smacks Down Jankowicz Again
On September 12, a three-judge panel of the Third Circuit Court of Appeals upheld a district court ruling tossing out Jankowicz’s defamation lawsuit against Fox News. She had claimed that Fox’s critical coverage of the board—and the board’s collapse under public backlash—defamed her personally.
But the panel ruled decisively that the criticisms were protected speech. According to the ruling, Jankowicz’s complaint failed because Fox’s commentary was either:
- Not about her directly
- Opinion, not fact
- Substantially true
The judges even warned that Jankowicz’s argument—that criticism of government policy amounts to defamation of a government official if their name or face is shown—was precisely the type of First Amendment violation the landmark New York Times v. Sullivan case forbids.
Fox News celebrated the decision, stating: “This was a politically motivated lawsuit aimed at silencing free speech, and we are pleased with the court’s decision to protect the First Amendment.”
Jankowicz Melts Down
Unwilling to accept the verdict, Jankowicz ranted online about being “furious” with the judges and accused America’s justice system of siding with “offenders instead of victims.” She argued that courts are “incapable of reconciling decades-old precedent with the realities of violent political rhetoric in the digital age.”
She doubled down on her grievance narrative, claiming the court’s ruling now allows “pundits to baselessly declare open season on people with whom they disagree.” In her telling, Fox News had created a “fake controversy” around her appointment that forced her resignation and destroyed her career.
But the court noted that of the 37 statements she challenged, 36 were about the Disinformation Board itself—not her personally. Chief Judge Colm Connolly even singled out one Hannity quote calling the board a “department … dedicated to working with the social media giants for the purpose of policing information” as not defamatory—because it was true.
From “Disinformation Czar” to Digital Beggar
With her legal dreams dashed, Jankowicz has now repackaged her GoFundMe as the “Nina Jankowicz Legal Defense Fund”—essentially asking donors to subsidize her failed crusade. She insists she is a “disinformation researcher” wronged by the system, but critics argue she was simply exposed as a would-be government censor trying to launder her agenda through the Department of Homeland Security.
The Bigger Picture: Propaganda vs. Free Speech
This case is about more than one disgruntled bureaucrat. It highlights a fundamental clash between the globalist agenda to police online speech and the American principle of free expression. Jankowicz’s defeat in court is a win for the First Amendment and a warning shot against those who would weaponize government power to silence dissent.
The prophetic undertones cannot be ignored: the spirit of censorship is rising worldwide, paving the way for authoritarian control under the guise of “protecting democracy.” But in this instance, at least, truth prevailed over propaganda.
Jankowicz may be furious, but the American people should be thankful—because Fox News just defended not only its own rights, but the rights of every citizen to speak truth to power.
