TC Energy, the Canadian company behind the Keystone XL pipeline which President Joe Biden cancelled on his first day in office, announced it was suing the U.S. government for $15 billion in damages.
TC Energy filed its lawsuit in July seeking damages “resulting from the revocation of the Keystone XL Project’s Presidential Permit.” The company claims the cancellation is the “U.S. Government’s breach of its NAFTA obligations”
States Suing Too
TC Energy’s lawsuit follows a federal lawsuit, filed by Texas Attorney General Ken Paxton and Montana Attorney General Austin Knudsen, on behalf of AGs from 23 states, seeking to have Biden’s Executive Order cancelling the Keystone XL’s cross-border permit declared unconstitutional and unlawful.
“Revocation of the Keystone XL pipeline permit is a regulation of interstate and international commerce, which can only be accomplished as any other statute can: through the process of bicameralism and presentment,” the States’ lawsuit says. “The president lacks the power to enact his ‘ambitious plan’ to reshape the economy in defiance of Congress’s unwillingness to do so.
“The Executive’s decision also encroaches upon the states’ abilities to steward and control the lands within their borders,” says the states’ filing.
“The order is both illegal and poorly thought out since it undermines the energy independence America achieved under former President Donald Trump,” said Paxton, in a separate statement. “President Biden has made it his mission to undo all the progress of the previous administration, with complete disregard for the Constitutional limits on his power [and] his decision to revoke the pipeline permit is not only unlawful but will also devastate the livelihoods of thousands of workers, their families, and their communities.”
Biden’s Energy Policies Harm America
The Biden administration’s energy policies are costing jobs and causing economic harm, says Dan Kish, a senior vice president of policy at the American Energy Alliance.
“The saddest part about President Biden’s clearly illegal action regarding the Keystone XL pipeline is that tens of thousands of Americans who could use good jobs have been cut off at the knees,” Kish said. “Instead of continuing to build infrastructure which, when completed, would supply 735 thousand barrels a day of Canadian oil and 100 thousand barrels a day of North Dakota oil, Biden has essentially said we will import more from other parts of the world.
“A federal judge saw the economic chaos of Biden’s leasing ban immediately, ruling the policy illegal policy, but the Biden Administration has so far ignored the Court’s ruling,” Kish said. “Americans are seeing the impact of anti-American energy policies every time they fill up; the extra $20 or so they’re paying could be going to their families but Biden’s American Oil Embargo is sending more and more American hard earned money abroad as imports continue to increase.” (Click to Source)
